• August 26, 2022 – The Attorney General for Florida and other people have shown support to reinstate the state’s gaming compacts made with the Seminole Tribe of Florida by appealing to the federal court to overturn the ruling made in November.

Florida sports betting was supposed to be legal as of October 2015, but a number of lawsuits seem to be holding things back. The Seminole Tribe and Florida governor Ron DeSantis filed briefs in September in support of the gaming compact in the state. After this happened, the Seminole Tribe did launch a Hard Rock Sportsbook app, but was taken down after a month of operation due to a lawsuit.

So, sports betting is kind of in a purgatory at the moment with the Seminole Tribe appealing the lawsuit.

After initially launching in November 2021, things were looking promising for Florida in terms of sports betting. 

However, after the lawsuit in late 2021, no movement on the Seminole Tribe’s appeal, and the failure to get enough signatures by February 1, 2022, it looks like we may need to wait until at least 2023 to get online legal sports betting in FL.

Will 2023 Be the Year to Legalize Sports Betting in Florida?

As of right now, there will not be any sports betting legislature up in 2022. We will not know more about any particular legislature until early to mid 2023.

While there are no current bills up for grabs when it comes to legalized online sports betting in FL, we will take a closer look at the lawsuit that resulted in the Hard Rock Sportsbook app being pulled and led us to where we are today.

Supporters

Offering gaming since 1979, the center of this fiasco is the Seminole Tribe, which launched the Hard Rock Sportsbook app in early November 2021. This came after an agreement with Governor Ron DeSantis to allow them to offer retail and online sports betting. 

However, the one aspect to keep in mind here is that the Seminole Tribe wanted to offer this outside Indian Tribal land. 

Beyond the Seminole Tribe, Senator Jeff Brandes introduced SB 293 in 2020 to bring online sports betting to the state.

Opponents

You’re probably wondering what the premise of bringing this lawsuit to the Seminole Tribe in the first place was.

This is quite a maze of information, but the abbreviated version is that West Flagler Associates, who represent Magic City Casino, brought the lawsuit to take down the Hard Rock Sportsbook app, citing Florida Amendment 3. 

Under this Amendment, any expansion of gaming must be sent for a vote. In their Memorandum Opinion, the Plaintiff (West Flagler) also cited that bringing the app to the state violates the Indian Gaming Regulatory Act, the Unlawful Internet Gambling Enforcement Act, the Wire Act, and the Equal Protection Clause. 

However, Amendment 3 doesn’t actually indicate anything related to “sports betting”. Instead, the amendment notes that voters get the “exclusive right to authorize casino gambling in Florida”.

Where Things Stand

After failing to receive enough signatures by February 1, 2022, there will be no referendum for online sports betting in Florida for the November 2022 meeting.

Right now, we are at a standstill as the Seminole Tribe is also appealing the lawsuit with no new updates.

• Senate Bill 968: A general sports betting bill that received little consideration.
• Senate Bill 970: Another sports betting bill that died early in the committee’s session.

2021

• Senate Bill 2-A: This will would mean the implementation of 2021 Gaming Compact Between the Seminole Tribe of Florida and the state and would allow for additional games, contests, and sports betting. 
• Senate Bill 392: One of a few senate bills that sought to legalize online sports betting but were abandoned after the Seminole Tribe and Florida worked toward a pact. 
• Senate Bill 394: Similar to SB-392.
• HB 1317: This will allow wagering on sports event using only licensied operators. It comes with procedures to prevent certain persons from wagering.
